Cargo Carried by Road

Just because a third party has caused loss and damage to cargo and property during road transit does not necessarily mean that they are liable for those losses and damages. Depending upon the circumstances surrounding a loss, the third party does have various defences upon which they can seek to rely. In addition, if the third party does have any liability, they can rely upon limits of liability, although these can be overcome in certain circumstances. Claims will also have time limits and will be lost if these time limits are not complied with, irrespective of the quantum and merits. Accordingly, claims for losses and damages to goods and property carried by road can be very complex, particularly where they involve more than one road carrier and more than one jurisdiction.

The team at Stean Shaw LLP can help. We have extensive experience and expertise in the handling and recovery of claims around the world involving the loss and damage to goods during carriage by road. These claims can arise on internal road movements within one country or jurisdiction or on international road movements involving more than one country or jurisdiction. We handle road claims under international conventions, such as the CMR convention covering road transportation between European countries. We also deal with road claims arising under the domestic legislation of individual countries. For example, we have extensive experience of the provisions of BIFA and RHA that can apply for shipments within the UK. We also have experience of handling domestic cases arising within most countries in Europe, the United States and all the continents of the world. We also have an extensive network of contacts throughout the world with whom we can liase in order to ensure the best outcome for our clients.

Since Stean Shaw LLP act on a “no win – no fee” basis, there is no cost “upfront” to our clients by using the services of Stean Shaw LLP to assist with the handling and recovery of cases involving carriage by road.  Stean Shaw LLP will only charge a fee when we succeed in obtaining a recovery for our clients. This is extremely beneficial as, for the reasons highlighted above, these types of claim can invariably involve considerable time, trouble and complexity to be finalised.
